AI Data Security: Keeping Your Business Data Safe

AI data security for businesses is the set of technical and organisational measures that prevents sensitive company information from leaking, being misused, or being processed without authorisation when you use AI tools and services. It's the question every business owner asks before committing to AI: "Is my data actually safe?"

The answer depends on three factors: which type of AI deployment you choose, what agreements you make with your vendor, and what technical safeguards you put in place. This article covers all three with concrete steps you can take today. No vague advice — hard facts and a checklist that works.

What Data Gets Sent to AI Systems?

The first step toward better security is understanding what actually happens when you use an AI tool. Not all data you put into an AI system is processed the same way.

What does get sent to an AI API:

  • The text you enter as a prompt (customer questions, emails, documents)
  • Attachments and files you upload for analysis
  • Conversation context within a session
  • Metadata such as timestamp, language, and session ID

What typically does not get sent:

  • Data from your internal systems that you haven't explicitly provided
  • Information from previous sessions (unless you have deliberately set the system up that way)
  • Files on your server that are not supplied as input

The critical distinction: an AI chatbot supporting your customer service sends only the customer question and relevant context to the API — not your entire customer database. But when an employee pastes a complete customer list into ChatGPT to "quickly run an analysis," everything goes. That's exactly the shadow AI risk that many businesses underestimate.

Cloud API vs. Private Cloud vs. On-Premise

How you deploy AI determines, to a large extent, how safe your data is. There are three main models, each with its own trade-offs.

For most SMBs, the cloud API is the right choice. Business APIs from OpenAI and Anthropic do not use your data for model training, offer data processing agreements, and encrypt data by default. Private cloud becomes relevant if you operate in a regulated industry. On-premise is only necessary for exceptional security requirements; think defence or intelligence agencies.

Data Processing Agreements: The Legal Foundation

A Data Processing Agreement (DPA) is mandatory under the GDPR whenever you have personal data processed by an external party. With AI tools, that's almost always the case. Read our in-depth article on GDPR and AI rules for the full legal context.

What a DPA must include at minimum:

  • Purpose of processing: what the AI provider may use your data for (and what it may not)
  • Categories of personal data: which types of data are processed
  • Retention period: how long data is stored after processing
  • Sub-processors: which third parties the provider engages
  • Security measures: what technical safeguards the provider has in place
  • Location of processing: where the servers are (EU or elsewhere)
  • Audit rights: your ability to verify that the provider adheres to the agreement

Red flags with AI vendors:

  • No DPA available or "not necessary"
  • Data used for model training without explicit opt-out
  • No clarity on data location
  • No information about sub-processors
  • Retention period is unlimited or unspecified

Encryption: The Technical Foundation

Encryption is the minimum technical requirement for any AI deployment. There are two types you need to understand:

Encryption in transit (TLS): Encrypts data while it travels from your system to the AI provider. All serious AI providers use TLS 1.2 or higher. This protects against eavesdropping in transit.

Encryption at rest (AES): Encrypts data while it is stored on the provider's servers. AES-256 is the standard. This protects against unauthorised access to stored data.

Where it goes wrong: the encryption itself is rarely the problem. The problem arises in the gaps: unsecured API keys, unencrypted log files, or employees sending data to an AI tool through insecure channels.

Make sure your API keys never appear in code or emails but are stored in a secure key vault. Do not log full prompts containing personal data. And do not use AI tools over public Wi-Fi without a VPN.

Evaluating AI Vendors on Security

Not every AI vendor takes security equally seriously. Use these five questions to evaluate a vendor:

  1. Do you have SOC 2 Type II certification? This is the gold standard for cloud security audits. Without SOC 2, you have no independent confirmation that security measures are in order.

  2. Where are your servers located? For GDPR compliance, EU data storage is strongly recommended. If data goes to the US, there must be a valid transfer mechanism (EU-US Data Privacy Framework).

  3. Is my data used for model training? On business accounts from OpenAI, Anthropic, and Google the answer is "no." On free accounts, the answer is often "yes." That difference is critical.

  4. How long do you retain my data? Some providers delete prompts after 30 days; others retain them indefinitely. Shorter is better. Ask about zero-retention options.

  5. What is your incident response process? Every company can be breached. The question is how quickly they notify you and what measures they take. The GDPR requires notification within 72 hours.

Practical Security Checklist

Use this checklist before deploying any new AI system:

Contractual:

  • Data processing agreement signed
  • Data location confirmed (EU preferred)
  • Retention periods agreed
  • Sub-processors mapped
  • Opt-out from model training confirmed

Technical:

  • TLS 1.2+ for all API connections
  • AES-256 encryption at rest
  • API keys stored in key vault (not in code)
  • Logging configured without full personal data
  • Access control: only authorised employees have API access
  • Rate limiting to prevent misuse of your API keys

Organisational:

  • AI policy drafted and communicated (see shadow AI policy)
  • Employees trained on what data may and may not go into AI tools
  • Incident response plan ready for AI-related data breaches
  • Annual review scheduled
